NOTA KESEPAHAMAN ANT ARA

PEMERINTAH REPUBLIK OF INDONESIA DAN

PEMERINTAH REPUBLIK ISLAM AFGHANISTAN TENT ANG

PENGEMBANGAN KAPASITAS ANGGOTA PENEGAK HUKUM

Pemerintah Republik Indonesia dan Pemerintah Republik Islam Afghanistan selanjutnya disebut "Para Pihak".

Berkeinginan untuk lebih meningkatkan dan memperkuat hubungan persahabatan yang telah terjalin antara para pihak;

Menegaskan kembali komitmen untuk membangun kemitraan yang lebih baik antara para pihak di bi<tlang yang menjadi perhatian umum termasuk kerjasama pengembangan kapasitas;

Mempertimbangkan kepentingan bersama dalam memperkuat hubungan antara para pihak untuk tujuan pengembangan kapasitas, khususnya, bagi personil penegak hukum;

Menyadari pentingnya pengembangan kapasitas untuk peningkatan tugas-tugas dan kinerja para personil penegak hukum;

Mengakui prinsip-prinsip kedaulatan, kemerdekaan, kesetaraan, integritas teritorial, tidak turut campur dan saling menguntungkan; dan

Sesuai dengan hukum dan peraturan yang berlaku di masing-masing negara;

Telah menyepakati sebagai berikut:

Pasal 1 Tujuan

Tujuan Nota Kesepahaman ini adalah untuk membangun kerangka kerja untuk meningkatkan kerjasama yang efektif di bidang pengembangan kapasitas, khususnya, pelatihan untuk personil penegak hukum;

Pasal2 Ruang Lingkup Kerja Sama

Para pihak akan bekerja sama dalam meningkatkan keahlian melalui pengembangan kapasitas dibidang-bidang sebagai berikut; A. Manajemen Lalu Lintas; B. Penyelidikan Terhadap Tindak Kriminal; C. Pelayanan Masyarakat oleh Kepolisian.

Pasal3 Peserta Pelatihan

1. Sesuai dengan tujuan Nata Kesepahaman, peserta program pelatihan adalah Palisi Nasional Indonesia (pelatih) dan Palisi Nasional Afghanistan (siswa).

2. Peserta pelatihan akan melakukan komunikasi secara terbuka untuk memastikan informasi dan program pelatihan yang mereka laksanakan sudah efektif.

3. Para peserta pelatihan wajib mematuhi hukum yang berlaku di Republik Indonesia selama mereka tinggal di dalam wilayah negara Republik Indonesia.

Pasal4 Bentuk Kerja Sama

1. Dalam melaksanakan ruang lingkup kerjasama tersebut, Palisi Nasional Indonesia akan menyediakan tenaga pelatih dan keahlian teknis kepada para peserta pelatihan, pada prinsipnya, 50 ( lima puluh ) lini pertama anggota Kepolisian Afghanistan dengan komposisi sebagai berikut:

A. 20 ( dua puluh ) personil untuk pelatihan manajemen lalu lintas; B. 15 (lima belas) personil untuk pelatihan penyelidikan terhadap tindak kriminal; C. 15 (lima belas) personil untuk pelatihan pelayanan masyarakat oleh kepolisian .

2. Komposisi tersebut dapat disesuaikan berdasarkan kebutuhan dilapangan dan ketersediaan tenaga SOM atas persetujuan para pihak.

Pasal5 MASA BERLAKU

1. Program pelatihan berdasarkan Nata Kesepahaman ini akan dilaksanakan satu kali pada tahun 2012.

2. Pelatihan akan berlangsung selama 14 (empat belas) hari, atau dapat disesuaikan berdasarkan kebutuhan yang disepakati oleh para pihak.

Pasal6 Pengaturan Keuangan

1. Seluruh aktivitas berdasarkan Nota Kesepahaman ini akan dibiayai oleh Law and Order Trust Fund in Afghanistan (LOTFA) dibawah pengaturan Kementerian Dalam Negeri, Republik Islam Afghanistan.

2. LOTFA akan menanggung seluruh biaya yang berkaitan dengan pelatihan sebesar Rp. 1.515.940.000 (setara dengan USO 158.224, sesuai dengan nilai tukar operasional PBB September 2012)* dan biaya tiket pesawat pulang-pergi untuk Polisi Nasional Afghanistan yang berpartisipasi dalam program pelatihan.

3. Metode dan pencairan dana akan ditetapkan dalam perjanjian terpisah antara Kepolisian Negara Republik Indonesia, c.q . Lemdikpol POLRI, dan LOTFA sesuai dengan peraturan dan undang-undang yang berlaku.

Pasal7 Kerahasiaan

Para pihak akan memastikan kerahasiaan informasi dan pengetahuan yang diperoleh dari pelaksanaan Nota Kesepahaman ini dan tidak akan mengungkapkan kepada pihak ketiga kecuali jika disepakati oleh para pihak.

Pasal8 Penyelesaian Sengketa

Setiap perselisihan yang mungkin timbul sebagai akibat dari penafsiran dan/atau pelaksanaan Nota Kesepahaman ini akan diselesaikan secara damai melalui konsultasi dan disampaikan melalui saluran diplomatik.

Pasal9 Amandemen

Nota Kesepahaman ini dapat diubah atau diperbaiki berdasarkan kesepakatan para pihak secara tertulis dan akan mulai berlaku sejak tanggal yang disepakati bersama para pihak.

Pasal 10 Ketentuan Terakhir

1. Nota Kesepahaman ini mulai berlaku sejak tanggal ditandatanganinya.

2. Nota Kesepahaman ini akan tetap berlaku sampai seluruh kegiatan yang tercakup dalam nota kesepahaman ini selesai dilaksanakan.

3. Nota Kesepahaman ini dapat dihentikan oleh para pihak dengan memberitahukan secara tertulis paling lambat 90 (sembilan puluh) hari sebelum tanggal penghentian yang dimaksud.

SEBAGAI BUKTI, yang bertandatangan di bawah ini, dengan diberi :uasa oleh masing-masing Pemerintah, telah menandatangani Nota Kesepahaman ini.

Ditandatangani dalam rangkap dua di Jakarta. pada tanggal 17 September tahun 2012 dalam bahasa Indonesia, Dari , dan lnggris, seluruh naskah mempunyai kekuatan hukum yang sama. Dalam hal terdapat perbedaan penafsiran, naskah dalam bahasa lnggris yang berlaku

MEMORANDUM OF UNDERSTANDING BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA, AND

THE GOVERNMENT OF ISLAMIC REPUBLIC OF AFGHANISTAN ON

CAPACITY BUILDING FOR LAW ENFORCEMENT PERSONNEL

The Government of the Republic of Indonesia and the Government of Islamic Republic of Afghanistan, hereinafter referred to as "the Parties";

Desiring to enhance and strengthened the existing friendly relations between the Parties;

Reaffirming the commitments to establish an enhanced partnership between the Parties in areas of common concern including cooperation on capacity building;

Considering the mutual interest in strengthening links between the Parties for the purpose of capacity building, in particular, for law enforcement personnel;

Realizing the importance of capacity building for the improvement of tasks and performance of law enforcement personnel;

Recognizing the principles of sovereignty, independence, equality, territorial integrity, non-interference and mutual benefit; and

Pursuant to the prevailing laws and re~ulations of the respective countries;

have reached the following understanding:

Article 1 Objective

The objective of this Memorandum of Understanding (MoU) is to establish a framework to enhance effective cooperation in areas of capacity building, in particular, training for law enforcement personnel;

Article 2 Scope of Cooperation

The Parties will cooperate in improving expertise through capacity building and training in the areas as follows;

a. Traffic management; b. Crime investigation; c. Police community service.

Article 3 Training Participants

1. For the purpose of this MoU, the Participants of training program will be The Indonesian National Police (Trainers) and the Afghan National Police (Trainees).

2. The Training Participants will open a channel of communication to ensure effective flow of information with regard to the training programs.

3. The participants of the training program shall respect the laws of the Republic of Indonesia during their stay in the territory of the Republic Indonesia.

Article 4 Forms of Cooperation

1. In implementing the scope of cooperation, the Indonesian National Police will provide trainers and technical expertise for the training attended, in principle, by 50 (fifty) first-line officers of the Afghan National Police with the following composition;

a. 20 (twenty) personnel for the training in traffic management. b. 15 (fifteen) personnel for the training in crime investigation. c. 15 (fifteen) personnel for the training in Police Community Service

2. The composition may be modified based on actual necessity and availability of personnel agreed by the Parties.

Article 5 Duration

1. The training program under this MoU will take place once in the year of 2012.

2. The training will have the duration of 14 (fourteen) days, or may be modified based on actual programs agreed by the Parties.

Article 6 Financial Arrangement

1. Activities implemented under this MoU will be financed by the Law and Order Trust Fund in Afghanistan (LOTFA) managed by the Ministry of Interior of Islamic Republic of Afghanistan and the United Nations Development Programme (UNDP).

2. The LOTFA will cover the costs relating to the training which is amounting to IDR 1.515.940.000 (equivalent to USO 158,224, as per United Nations Operational rates of Exchange September 2012)* and the return airfare for the Afghan National Police participating in the training program.

3. The method and disbursement of funding will be stipulated in separate agreement between the Indonesian National Police, c.q. the Department of Education of the Indonesian National Police, and the LOTFA in accordance with prevailing laws and regulations.

Article 7 Confidentiality

The Parties will ensure the confidentiality of information and knowledge obtained from the implementation of this MoU and will not disclose to any third party unless otherwise agreed upon by the Parties.

Article 8 Dispute Settlement

Any disputes of differences that may arise as a result of interpretation and/or implementation of this MoU will be settled amicably through consultation of negotiation between the Parties through diplomatic channels.

Article 9 Amendment

This MoU may be amended or revised by written consent of the Parties and will come into effect on the date agreed by the Parties.

Article 10 Final Provisions

1. This MoU will enter into force on the date of its signing.

2. This MoU will remain in effect until the conclusion of the activities covered in this Mou.

3. This MoU may be terminated by the Parties with prior written notification at least 90 (ninety days) before the intended termination date.

IN WITNESS WHEREOF, the undersigned being duly authorized by their respective Government have signed this Memorandum of Understanding.

Done in duplicate at Jakarta on this 1t 11 day of September in year two thousands and twelve in Bahasa Indonesia, Dari, and English languages, all texts being equally authentic. In case of any divergences of interpretation, the English text will prevail.
