Keyakinan dalam KepastianConfident in CertaintySebagai lembaga yang ditunjuk Pemerintah Indonesia untuk menjaga kepentingan nasabah perbankan, Lembaga Penjamin Simpanan (LPS) berhasil meningkatkan kepercayaan masyarakat luas pada perbankan nasional dalam beberapa tahun terakhir. Penjaminan simpanan nasabah bank yang dilakukan oleh LPS memberi keyakinan dan kepastian akan keamanan simpanan dana dan dengan demikian masyarakat tidak akan ragu untuk melakukan transaksi perbankan.

As an institution appointed by the Government of Indonesia to safeguard the interests of bank customers, the Indonesian Deposit Insurance Corporation (IDIC) succeeded in increasing public confidence in the nation banking in recent years. By providing insurance over bank deposits, IDIC gives confidence and certainty on the security of deposit of funds and, hence, the community will not hesitate to do banking transactions.

Indikator ekonomi selama tahun 2010 menunjukkan bahwa secara umum perekonomian nasional diwarnai dengan banyak pencapaian-pencapaian yang baik. Pertumbuhan ekonomi 6,1%, inflasi bisa dikendalikan pada tingkat 6,9% dengan tingkat inflasi inti 4,28% ditopang oleh apresiasi rupiah serta surplus neraca transaksi berjalan sebesar USD 6,2 Miliar atau 0,9% dari Produk Domestik Bruto. Kondisi perekonomian yang kondusif ini berdampak positif kepada iklim usaha sehingga kondisi industri perbankan tumbuh dengan baik. Prospek dan ketahanan ekonomi nasional juga menarik minat investor asing sehingga Foreign Direct Investment mencapai USD12,6miliar atau 3 kali lipat dari angka tahun 2009. Neraca pembayaran menunjukkan surplus USD 30miliar, sehingga cadangan devisa mencapai USD 96,2miliar atau naik 45% dibandingkan dengan tahun 2009.

Economic indicators showed that Indonesias economy generally performed positively in 2010. This was clearly reflected by economic growth of 6.1%, inflation maintained at a controllable level of 6.9% with core inflation at 4.288%, which was supported by the Rupiahs appreciation, and current balance of payment surplus amounted to US$ 6.2 billion, or 0.9% of the Gross Domestic Product. This conducive economic condition affected the industrys climate thereby drove the banking industry to grow positively. Indonesias economic resilience and prospects attracted foreign investor interest driving Foreign Debt Investment to USD12.6 billion, or 3 times the figure achieved in 2009. Balance of payment produced a surplus of USD 30 billion, while foreign exchange reserves amounted to US$ 96.2 billion or increased 45% from 2009.

Rencana strategis LPS yang dicanangkan pada bulan September 2010 telah memberi peluang pengelolaan LPS secara lebih berencana dengan hasil yang efektif. Kami melengkapinya dengan penerapan metodologi manajemen kinerja yang disesuaikan guna meningkatkan budaya kinerja lembaga.IDIC strategic plan which was established in September 2010 has given an opportunity for more planned and effective management of IDIC. We have equipped it with the implementation of performance management methodology which has been adjusted to improve the institutions performance culture.

Secara menyeluruh rasio-rasio keuangan perbankan terkait dengan prudential practices dapat dicapai sesuai harapan. Pertumbuhan aset perbankan meningkat 18,7% dan ekspansi kredit meningkat 22,8%, rasio kecukupan modal bank rata-rata 17,2%, NPL gross 2,56%, likuiditas terjaga dengan baik serta kemampuan perbankan menghasilkan laba yang tercermin dari Net Interest Margin (NIM) bank berada sekitar 5,7%. Kondisi ketahanan keuangan perbankan yang stabil dan sangat baik ini, menempatkan risiko LPS sebagai pelaksana penjaminan dan resolusi bank gagal, berada dalam tingkatan yang relatif rendah. Perlu kami sampaikan bahwa Dana Pihak Ketiga Perbankan pada tahun 2010 mencapai Rp2.370,98 triliun. Dari jumlah tersebut sebesar Rp1.435,20 triliun yang merupakan 99,88% jumlah rekening Dana Pihak Ketiga termasuk dalam penjaminan LPS, yang langsung atau tidak langsung jumlah tersebut menggambarkan exposure risiko LPS. Dari sisi keuangan LPS selama tahun 2010, dapat kami sampaikan bahwa secara keseluruhan kinerja keuangan LPS baik. Hal tersebut ditunjukan oleh pengumpulan premi dapat dilaksanakan sesuai ketentuan, investasi yang konservatif, biaya operasi dan administrasi yang dikelola dengan efisien, pembayaran klaim yang relatif tidak besar serta pembentukan cadangan klaim penjaminan dilakukan sesuai ketentuan. Opini hasil audit BPK RI atas laporan keuangan 2010 adalah tidak memberikan pendapat (disclaimer) sama dengan opini atas laporan keuangan tahun 2009. Hal tersebut, antara lain, disebabkan oleh penyajian Penyertaan Modal Sementara (PMS) pada PT Bank Mutiara, Tbk dilakukan berdasarkan nilai historis (historical cost) dan bukan nilai wajar (fair value) sebagaimana pandangan BPK RI.

Overall, the banking sectors financial ratios pertaining to prudential practices can be achieved as expected. The banking sectors assets increased 18.7% and loan expansion grew 22.8%, while average capital adequacy ratio was at 17.2%, gross NPL was at 2.56%, and well maintained liquidity along with the banking sectors ability to produce profits was clearly reflected in the bank sectors Net Interest Margin of around 5.7%. A stable and good condition of bankings financial resilience has put IDIC risk, as the executor of deposit insurance and failed bank resolution, in a relatively low level. The third party fund in 2010 was amounting to Rp2,370.98 trillion. From that amount, as many as Rp1,435.20 trillion represented 99.88% of total account of third party fund insured by IDIC which directly or indirectly describing IDIC risk exposure.

Financially, in 2010, IDICs financial performance in overall was performing well. It reflected by premium collection can be conducted as prescribed by the regulation, conservative investment, effectively managed operating and administration cost, relatively moderate claim payments as well as the establishment of provision for insurance claims in accordance with applicable regulations. The Audit Board of the Republic of Indonesia (BPK RI) has provided a disclaimer opinion toward IDICs financial statements for 2010 which was the same as in 2009. It was caused by the presentation of Temporary Capital Placement in PT Bank Mutiara, Tbk which used historical cost instead of fair value as the view of BPK RI.

Rencana strategis LPS yang dicanangkan pada bulan September 2010 telah memberi peluang pengelolaan LPS secara lebih berencana dengan hasil yang efektif. Kami melengkapinya dengan penerapan metodologi manajemen kinerja yang disesuaikan guna meningkatkan budaya kinerja lembaga. Disamping melaksanakan fungsi pokok penjaminan dan penyelamatan bank pada tahun 2010, program-program kerja dan inisiatif di LPS bertumpu pada perbaikan praktik tata kelola, manajemen risiko, dan pengelolaan SDM. Kami fokus pada peningkatan kemampuan akses data makro ekonomi dan industri perbankan sehingga risiko pengelolaan LPS dapat dianalisa, diukur dan dimitigasi secara lebih baik. Disamping itu LPS juga sadar akan perlunya meningkatkan pemahaman nasabah perbankan tentang program penjaminan LPS melalui akses elektronik, pendidikan, serta program komunikasi khusus yang dirancang untuk itu. Pada tahun 2010 terdapat 10 Bank BPR yang ditutup dengan portofolio Dana Pihak Ketiga sebesar Rp28,03 miliar telah dibayar penjaminannya, sementara ada 5 Bank BPR yang proses likuidasinya telah diselesaikan. Kami juga melaporkan bahwa PT Bank Mutiara, Tbk yang telah menerima Penyertaan Modal Sementara LPS telah mencapai kinerja yang baik sesuai harapan. Untuk tahun 2011 inisiatif-inisiatif tersebut tetap dilanjutkan. Tahun 2010 sudah kita lewati dengan baik. Namun, tantangan ke depan tetap harus kita waspadai. Ancaman krisis dapat datang secara tiba-tiba, baik berasal dari internal maupun eksternal. Dalam rangka mengantisipasi risiko tersebut, LPS merasa perlu mendorong kiranya Pemerintah bersama dengan DPR dapat menyelesaikan pembahasan RUU JPSK. Dengan adanya UU JPSK diharapkan para pengambil keputusan dapat melaksanakan tugasnya dalam menyelamatkan perekonomian nasional dengan landasan hukum yang kuat. Selain itu, koordinasi penanganan krisis dapat lebih efektif sehingga dapat meminimalkan biaya, karena kunci penanganan krisis adalah kecepatan dan keakuratan tindakan.Lembaga Penjamin Simpanan Laporan Tahunan 2010

IDIC strategic plan which was established in September 2010 has given an opportunity for more planned and effective management of IDIC. We have equipped it with the implementation of performance management methodology which has been adjusted to improve the institutions performance culture. Apart from carrying out of its main functions of insuring deposit and resolving banks, in 2010, work programs and initiatives were concentrated in the improvement on good governance practices, risk management, and human resources management. We were focusing the amelioration on the macroeconomics and banking industry data accessibility so that IDIC risk management can be better analized, calculated and mitigated. Moreover, IDIC realizes the needs on improving the awareness of bank depositors on IDIC deposit insurance program by using several access like electronic media, education as well as specially-designed communication programs. In 2010, there were 10 rural banks liquidated with a total third party fund of Rp28,03 billion has been paid its insurance and liquidation process of 5 rural banks have been completed. We also note that PT Bank Mutiara, Tbk which had received a temporary capital investment from IDIC, has achieved a good performance. For 2011, initiatives are to be continued.

We have successfully passed 2010. However, we still need to take heed of the challenges ahead. The threat of a crisis, either internally or externally, can suddenly occur. To anticipate this risk, IDIC strongly urge the government to immediately propose the Financial Safety Net bill to the House of Representatives. Decision makers will have, through enactment of the Financial Safety Net Law, a strong legal basis to perform their duties of saving the national economy in a time of crisis. Moreover, coordination needed to handle a crisis can be conducted fast to minimize costs, as the key factors for successfully handling a crisis involves timely response and the application of appropriate measures. The contents of the Financial Safety Net bill clearly describes the role of each party as well as the measures needed to be taken simultaneously without having to wait for each others decision or action.

Dalam kesempatan ini, kami ingin menyampaikan terimakasih dan penghargaan setinggi-tingginya kepada semua pihak yang mendukung pelaksanaan tugas dan fungsi LPS. Khusus kepada industri perbankan, kami juga ingin menyampaikan terima kasih atas peran sertanya dalam menjaga stabilitas sistem perbankan melalui penerapan prinsip-prinsip prudential banking, good corporate governance, dan manajemen risiko yang baik. Tak lupa kami ingin menyampaikan terima kasih atas dukungan tim eksekutif dan seluruh karyawan LPS dalam rangka upaya LPS untuk selalu menjadi lebih baik. Akhir kata, kami juga ingin menyampaikan selamat jalan kepada Dewan Komisioner yang telah berakhir masa pengabdiannya kepada LPS pada tahun 2010 ini, dan kepada anggota Dewan Komisioner yang baru kami ucapkan selamat bergabung untuk mendarmabaktikan karya terbaiknya kepada LPS sehingga LPS dapat memenuhi harapan seluruh stakeholders. Demikian pengantar dari kami, semoga Laporan Tahunan ini dapat memberikan penjelasan atas kegiatan-kegiatan yang dilakukan LPS dalam rangka menjalankan fungsi dan tugasnya sesuai UU LPS. Laporan Tahunan ini merupakan salah satu bentuk akuntabilitas kami terhadap para stakeholders.

IDIC would like to especially extend our gratitude to the banking industry and acknowledge their role in maintaining the stability of the banking system stability through the application of prudential banking principles, good corporate governance and sound risk management.

Lastly, we would like to bid farewell to the members of the Board of Commissioners whose terms of service with IDIC has ended in 2010 and welcome members of the Board of Commissioners that have recently joined IDIC and are prepared to dedicate themselves and provide their best to meet stakeholder expectations.

We sincerely hope our Annual Report provides both clarity and valuable insights into IDICs activities related to the fulfillment of its functions and duties as mandated by the IDIC Law. This Annual Reports serves as part of our accountability to the stakeholders.

Puji dan syukur kami panjatkan kehadirat Tuhan YME, karena atas berkat-Nya LPS dapat menjalani tugas yang dimandatkan oleh Undang-Undang Lembaga Penjamin Simpanan dengan baik meskipun tidak sedikit tantangan yang harus dihadapi oleh LPS selama lima tahun perjalanannya melaksanakan mandat tesebut. Dalam pelaksanaan fungsi penjaminan simpanan, LPS pada tahun 2010 melindungi nasabah 1.990 bank yang beroperasi di Indonesia, baik itu bank umum, bank perkreditan rakyat maupun bank pembiayaan rakyat syariah. Dengan nilai maksimum simpanan yang dijamin sebesar Rp2 miliar, pada tahun 2010, tercatat nilai simpanan yang dijamin oleh LPS senilai Rp1.435,2 triliun atau 60,53% dari total seluruh simpanan. Sebaran simpanan pada bank umum mayoritas berada pada deposito sebesar Rp1.087,79 triliun (45,88%), diikuti oleh tabungan sebesar Rp733,68 triliun (30,94%) dan giro sebesar Rp540,90 triliun (22,81%).

Praise and gratitude expressed toward the Almighty for His endless blessings to IDIC so that IDIC could carry out the duties mandated by the IDIC Law effectively in its five years journey in spite of challenges experienced.

In conducting deposit insurance function, IDIC, in 2010, has protected depositors in spite of 1,990 banks that operate in Indonesia, which comprised of it is commercial banks, rural banks, or islamic based rural banks. With a maximum amount of deposit insured of Rp2 billion, in 2010, the deposit insured by IDIC was of Rp1,435.2 trillion or 60.53% of total deposit. The distribution of the majority of deposits in commercial banks were on time deposit amounting to Rp1,087.79 trillion (45.88%), followed by savings amounting to Rp733.68 trillion (30.94%) and current accounts amounted to Rp540.90 trillion (22.81%).

Dengan nilai maksimum simpanan yang dijamin sebesar Rp2 miliar, pada tahun 2010, tercatat nilai simpanan yang dijamin oleh LPS senilai Rp1.435,2 triliun atau 60,53% dari total seluruh simpanan.With a maximum amount of deposit insured of Rp2 billion, in 2010, the deposit insured by IDIC recorded at the amount of Rp1,435.2 trillion or 60.53% of total deposit.Selama tahun 2010, LPS melakukan analisis resolusi bank terhadap beberapa bank bermasalah yang diklasifikasikan oleh Bank Indonesia sebagai Bank Dalam Pengawasan Khusus dan 10 bank diantaranya ditetapkan sebagai bank gagal dan dicabut izin usahanya oleh Bank Indonesia. LPS kemudian mulai melaksanakan proses likuidasi terhadap 10 bank tersebut. Dengan demikian, sejak tahun 2006, LPS melikuidasi 31 bank, 30 BPR/BPRS dan 1 bank umum, yang tersebar di berbagai wilayah Indonesia seperti Sumatra, Jawa, Bali dan Sulawesi. Pada tahun 2010, LPS telah menyelesaikan proses likuidasi 5 bank. Selain itu, sejak awal beroperasi hingga akhir tahun 2010, LPS telah membayarkan klaim penjaminan simpanan sebesar Rp584,09 miliar. Per 31 Desember 2010, cadangan klaim penjaminan simpanan LPS, yang dibentuk sebagai antisipasi kerugian LPS akibat pembayaran klaim, mencapai Rp11,10 triliun. Dalam rangka menjalankan fungsi LPS yang kedua yaitu ikut serta dalam memelihara stabilitas sistem perbankan, pada tahun 2010 ini, LPS terus melanjutkan penanganan PT Bank Century, Tbk (saat ini PT Bank Mutiara, Tbk) yang telah ditetapkan sebagai bank gagal yang berdampak sistemik pada tanggal 20 November 2008. Dalam rangka menuju pelaksanaan divestasi PT Bank Mutiara, Tbk., LPS memfokuskan penanganan PT Bank Mutiara, Tbk tersebut pada peningkatan kinerja bank guna meningkatkan nilai bank serta melakukan persiapan-persiapan pelaksanaan divestasi PT Bank Mutiara, Tbk. Pada tahun 2010, LPS juga melakukan evaluasi terhadap nilai simpanan yang dijamin oleh LPS yang berlaku saat ini serta mengevaluasi premi penjaminan simpanan yang diterapkan oleh LPS hingga sekarang. Kami menyadari bahwa guna memberikan pelayanan yang terbaik bagi para stakeholder, LPS perlu terus meningkatkan kapabilitas dan dukungan operasionalnya. LPS melakukan (1) pengembangan organisasi diantaranya melalui penyempurnaan struktur organisasi, rekrutmen pegawai, pemberian pelatihan During 2010, IDIC performed bank resolution analysis on a number of problem banks that were classified as under special surveillance unit by Bank Indonesia, wherein ten of these banks were subsequently classified as failed banks and their banking license revoked by Bank Indonesia. IDIC subsequently carried out the liquidation process for these ten banks. As a result, since 2006, IDIC has liquidated 31 banks which comprised of 30 rural banks and 1 commercial bank from various regions in Indonesia such as Sumatra, Java, Bali and Sulawesi. In 2010, IDIC completed the liquidation process of 5 liquidated rural banks. In addition to this, IDIC has paid insurance claims of Rp584.09 billion. As of 31 December 2010, IDICs insurance reserve, which was established in anticipation of losses arising from claim payment, amounted to Rp11.10 trillion.

In 2010, IDIC evaluated the current amount of deposit insured by IDIC and evaluated deposit insurance premium applied by IDIC up to present time.

We realize that in order to provide excellent service to our stakeholders, IDIC needs to continuously enhance its capabilities and operational supports. Therefore, throughout 2010, IDIC has carried out (1) organizational development efforts by refining the organizational structure, recruiting new staff, providing

In regards to IDICs second function of actively participating in maintaining the stability of banking system, in 2010, IDIC continued the resolution of PT Bank Century, Tbk (now PT Bank Mutiara, Tbk) was as a systemic failed bank on 20 November 2008. In view of impending of PT Bank Mutiara, Tbk, IDIC intends to focus on resolving PT Bank Mutiara, Tbk by improving banks performance to a level that enhances the banks value while simultaneously initiating preparation on the divestment of PT Bank Mutiara, tbk.

Pada tahun 2010, LPS telah menandatangani beberapa nota kesepahaman dengan beberapa institusi-institusi terkait baik dalam negeri, seperti dengan Bank Indonesia dan Badan Pemeriksa Keuangan, maupun luar negeri seperti Korea Deposit Insurance Corporation dan Tripartite Memorandum of Understanding dengan Deposit Protection Agency Thailand dan Malaysia Deposit Insurance Corporation.

Moreover, in regards to the implementation of both of IDICs functions, good coordination and cooperation with a related party serves an important factor that needs to be enhanced. In 2010, IDIC signed a number of Memorandum of Understanding (MOU) with related institutions in Indonesia such as Bank Indonesia, the Ministry of Finance of the Republic of Indonesia, and the Audit Board of the Republic of Indonesia, as well as with overseas institution such as Korea Deposit Insurance Corporation (KDIC), Malaysia Deposit Insurance Corporation (MDIC) and Deposit Protection Agency of Thailand (DPA). The MOU signed between, DPA and IDIC was made during the Tripartite Meeting held in Jakarta. IDICs achievements throughout its five years operating were attributed to the hard work and dedication of its employee as well as the good cooperation between IDIC and its stakeholders. Hence, we would like to take this opportunity to extend our utmost gratitude and appreciation to directors and all of our employee for their utmost dedication and loyalty to IDIC as well as to all parties that have supported IDIC in carrying out our duties. We hope that the good level of cooperation which have been established will continue to strengthen as part of our efforts to create a strong banking condition so that the financial system stability, particularly banking system, remained. Finally, may the Almighty always give protect and bestow His grace to us all. Amin.

Kami, atas nama Dewan Komisioner Lembaga Penjamin Simpanan (LPS), menyatakan telah menyetujui dan bertanggung jawab penuh atas kebenaran isi Laporan Tahunan LPS tahun 2010. Laporan Tahunan LPS juga memuat Laporan Keuangan LPS yang berakhir per 31 Desember 2010 yang telah diaudit oleh Badan Pemeriksa Keuangan Republik Indonesia.

IKHTISAR KEUANGAN LPS 2010Financial Highlights 2010

AKTIVAPer 31 Desember 2010, total aktiva mencapai Rp22,55 triliun, mengalami kenaikan sebesar Rp4,81 triliun atau 27,11% dari akhir tahun 2009. Total aktiva sebesar Rp22,55 triliun tersebut terutama terdiri dari Investasi dalam Surat Berharga sebesar Rp15,35 triliun, Penyertaan Modal Sementara sebesar Rp6,76 triliun, Piutang Investasi sebesar Rp218,30 miliar, Aktiva Tetap sebesar Rp126,49 miliar serta Kas dan Setara Kas sebesar Rp60,76 triliun.

ASSETSIDICs total assets, as of 31 December 2010, was Rp22.55 trillion, Rp4.81 trillion or 27.11% higher than that achieved at the end of 2009. The Rp22.55 trillion in total assets comprised of Investment in Securities amounting to Rp15.35 trillion, Temporary Capital Placement of Rp6.76 trillion, Account Receivable-Interest on Investment of Rp218.30 billion, Fixed Asset of Rp126.49 billion and Cash and Cash Equivalent of Rp60.76 billion.

KEWAJIBAN DAN EKUITASJumlah kewajiban per 31 Desember 2010 adalah sebesar Rp11,25 triliun, meningkat sebesar 52,44% dari kewajiban akhir tahun 2009. Kewajiban sebesar Rp11,25 triliun terutama terdiri dari Hutang Klaim Penjaminan sebesar Rp36,66 miliar, Cadangan Klaim Penjaminan sebesar Rp11,10 triliun, dan Hutang Pajak sebesar Rp96,76 miliar. Ekuitas per 31 Desember 2010 sebesar Rp11.30 triliun, meningkat 9,07% atau Rp0,94 triliun dari ekuitas akhir tahun 2009.

LIABILITIES AND EqUITYTotal liabilities as of 31 December 2010 amounted to Rp11.25 trillion, or increased 52.44% compared to total liabilities at the end of 2009. IDICs Rp11.25 trillion in total liabilities primarily consisted of Insurance Claim Payable amounting to Rp36.66 billion, Provision for Insurance Claims amounting to Rp11.10 trillion, and Tax Payables amounting to Rp96.76 billion. Total equities as of 31 December 2010 amounted to Rp11.30 trillion, or increased 9.07% or Rp0.94 trillion more than that achieved at the end of 2009.

PENJELASAN LPS ATAS OPINI BADAN PEMERIKSA KEUANGAN TERHADAP LAPORAN KEUANGAN LPS 2010Clarification on the Audit Board of the Republic of Indonesias Findings Toward IDICs 2010 Financial StatementsBadan Pemeriksa Keuangan Republik Indonesia (BPK-RI) telah melakukan pemeriksaan atas Laporan Keuangan Lembaga Penjamin Simpanan (LPS) Tahun 2010. Hasil pemeriksaan BPK RI tersebut dituangkan` dalam Laporan Nomor 03.a/LHP/ XV.3/03/2011 tanggal 14 Maret 2011. Dalam laporan hasil pemeriksaan tersebut, BPK RI memberikan pendapat Tidak Memberikan Pendapat (Disclaimer) terhadap Laporan Keuangan LPS tahun buku 2010. Pendapat BPK RI terhadap Laporan Keuangan LPS tahun 2010 tersebut semata-mata disebabkan adanya perbedaan pandangan antara BPK RI dengan LPS dalam penyajian laporan keuangan, yaitu mengenai: 1. Penyajian Nilai Penyertaan Modal Sementara (PMS) LPS pada Bank Mutiara, Tbk (d.h. PT Bank Century, Tbk) dicatat dalam laporan keuangan LPS berdasarkan prinsip historical cost. The Audit Board of the Republic of Indonesia (BPK-RI) has audited the Indonesia Deposit Insurance Corporations (IDIC) Financial Statements for 2009. BPK RIs audit findings are attached to Report Number 03.a/LHP/XV.3/03/2011 dated 14 March 2011.

BPK RI has, through its audit findings report, provided a disclaimer opinion towards IDICs Financial Statements for 2010 .

BPK RIs opinion towards IDICs Financial Statements for FY 2010 clearly points to differences between BPK RIs viewpoint with that of IDICs in regards to the contents of the financial statements, specifically in regards to: 1. The presentation of the amount of Temporary Capital Placement in PT Bank Mutiara, Tbk (previously known as PT Bank Century, Tbk) as specified in IDICs 2010 Financial Statements based on historical cost principles. BPK RIs viewed that the presentation of Temporary Capital Placement should be based on its fair value so as to best capture the estimated recoverable amount, as opposed to using the historical cost as stated in IDICs Financial Statement. 2. The impact of BPK RIs investigative audit findings on the contents of IDICs 2010 and 2009 Financial Statements, specifically in regards to the legal basis for the Temporary Capital Placement in PT Bank Century, Tbk made after 18 December 2008 and the legitimacy of the handover of PT Bank Century, Tbk. from the Coordinating Committee to IDIC.Lembaga Penjamin Simpanan 2010 Annual Report

BPK RI berpandangan bahwa penyajian PMS seharusnya menggunakan nilai wajar (fair value) yang dapat menggambarkan taksiran jumlah yang dapat diperoleh kembali (recoverable amount) bukan historical cost sebagaimana disajikan dalam Laporan Keuangan LPS. 2. Pengaruh temuan pemeriksaan investigasi BPK terhadap Laporan Keuangan LPS Tahun 2010 dan Tahun 2009, yaitu mengenai dasar hukum penyaluran dana PMS pada Bank Century setelah tanggal 18 Desember 2008 dan legitimasi penyerahan penanganan Bank Century dari Komite Koordinasi (KK) ke LPS.

Menurut BPK RI, sebagaimana tercantum pada paragraf 4 Laporan Auditor Independen Nomor 03.a/LHP/XV.3/03/2011 tanggal 14 Maret 2011, bahwa terdapat ketidakpastian yang muncul dari interpretasi hukum dan peraturan yang berlaku, termasuk pengaruhnya terhadap laporan keuangan atas temuan BPK yang sampai saat ini belum ditetapkan aparat penegak hukum sebagai unsur tindakan melanggar hukum, yaitu mengenai (1) penyaluran dana PMS kepada PT Bank Century, Tbk setelah tanggal 18 Desember 2008 yaitu setelah

Perppu No.4 Tahun 2008 ditolak DPR sebesar Rp2.886.221.000 ribu tidak memiliki dasar hukum; (2) Pada saat penyerahan PT Bank Century, Tbk dari KK kepada LPS tanggal 21 November 2008, kelembagaan KK yang beranggotakan Menteri Keuangan (selaku Ketua), Gubernur BI (selaku Anggota) dan Ketua Dewan Komisioner LPS (selaku Anggota) belum pernah dibentuk berdasarkan UU sebagaimana dimaksud dalam Penjelasan Pasal 21 ayat (2) UU No. 24 Tahun 2004 sehingga mempengaruhi status hukum atas keberadaan lembaga KK dan penanganan PT Bank Century, Tbk oleh LPS.

Presentation of IDICs Temporary Capital Placement a. Economic Substance of Temporary Capital Placement based on the IDIC Law. The presentation of IDICs Temporary Capital Placement in PT Bank Mutiara, Tbk (previously known as PT Bank Century, Tbk) as specified in IDICs Financial Statements in 2010 use historical cost that takes into account the economic substance and characteristic of Temporary Capital Placement based on IDIC Law which differ from the Capital Placement made by an entity for commercial purposes, i.e: Based on IDIC Law, IDICs Temporary Capital Placement is not aimed at gaining a return, but is instead aimed at accomplishing one of IDICs function of actively maintaning the stability of the banking system in accordance with Article 4 letter b of the IDIC Law and to strengthen Indonesias financial sector as prescribed within the General Explanation of the IDIC Law. In regards to this, since 2006, IDIC has an accounting guideline that it uses to register the Temporary Capital Placement in accordance with its acquisition value, which is the amount of its resolution cost. This is different with the objectives of investing by an entity for commercial purposes that specifically seeks to secure return and/or control a company for the purpose of obtaining economic gain or benefit, which according to the Indonesian Accounting Standards (PSAK) must be booked in accordance with its fair market value.

Berkaitan dengan pandangan BPK RI tersebut, LPS dapat menjelaskan hal-hal sebagai berikut: 1. Penyajian Penyertaan Modal Sementara (PMS) LPS. a. Substansi Ekonomi PMS Berdasarkan UU LPS. Penyajian PMS LPS pada Bank Mutiara (d.h. Bank Century) pada Laporan Keuangan LPS Tahun 2010 sesuai dengan biaya penyelamatan yang telah dikeluarkannya (historical cost) dilakukan dengan pertimbangan pada substansi ekonomi dan karakteristik PMS berdasarkan UU LPS yang sangat berbeda dengan penyertaan modal oleh suatu entitas dengan tujuan komersial, yaitu:

BerdasarkanUULPS,PMSLPStidakdimaksudkan untuk memperoleh return, namun semata-mata untuk melaksanakan salah satu fungsi LPS yaitu turut aktif dalam memelihara stabilitas sistem perbankan sesuai dengan Pasal 4 huruf b UU LPS dan untuk menciptakan ketahanan sektor keuangan Indonesia sebagaimana disebutkan dalam Penjelasan Umum UU LPS. Sehubungan dengan itu, sejak tahun 2006, LPS telah memiliki pedoman akuntansi untuk keperluan dimaksud yang mencatat PMS sesuai nilai perolehannya, yaitu sebesar biaya penyelamatan. Hal ini berbeda dengan tujuan penyertaan modal oleh entitas dengan tujuan komersial yang dimaksudkan untuk memperoleh return dan/atau untuk memiliki atau menguasai suatu perusahaan dalam rangka memperoleh manfaat ekonomi, yang menurut PSAK harus mencatat sesuai nilai wajar (pasar).

PMS Bukan Merupakan Investasi. Berdasarkan Pasal 82 ayat (2) UU LPS, kekayaan yang berbentuk investasi hanya dapat ditempatkan pada surat berharga yang diterbitkan oleh Pemerintah Indonesia dan/atau Bank Indonesia. Dengan demikian PMS tidak dapat diperlakukan sebagai investasi. Ketentuan dalam pasal ini selaras dengan uraian diatas bahwa pertimbangan dan keputusan melakukan PMS sangat berbeda dengan sebagaimana lazimnya pertimbangan dan keputusan investasi diambil.

TemporaryCapitalPlacementIsNotAnInvestment. According to Article 82 verse (2) of IDIC Law, assets that are in the form of investment can only be placed in securities that are issued by the government of Indonesia and/or Bank Indonesia. Therefore, Temporary Capital Placement can not be deemed as investment. The provision within this Article is in accordance with the above-mentioned description whereby the consideration and determination for the temporary capital placement differs from the consideration and decision generally applied for investments. The Temporary Capital Placement essentially is the costs for handling the resolution of Failed Bank. Article 41 section (2) of the IDIC Law stipulates that all of the resolution costs of the failed bank that is disbursed by IDIC represents IDICs Temporary Capital Placement. This is entirely different from the capital investment made by an entity for commercial purposes, wherein the stated value is essentially represents the acquisition cost for controlling a company within the context of obtaining economic benefit/gain. IDICs Temporary Capital Placement is limited in terms of its value and (divestment) timeframe. Based on Article 42 of the IDIC Law, IDIC is required to sell all of its shares in PT Bank Mutiara, Tbk at a price not less than the entire amount of its Temporary Capital Placement and not later than 3 (three) years since it began its resolution of the bank that can be extended twice within an extended period of not more than one year each (totalling a maximum of 5 years). If IDIC cannot obtain an optimum offer upon completion of the 5 year timeframe, therefore, IDIC can then divest its stake (Temporary Capital Placement) at a value below that of its Temporary Capital Placement.

PMS pada hakekatnya merupakan biaya penanganan untuk menyelamatkan Bank Gagal. Ketentuan Pasal 41 ayat (2) UU LPS mengatur bahwa seluruh biaya penanganan bank gagal yang dikeluarkan LPS menjadi PMS LPS. Hal ini berbeda dengan penyertaan modal oleh entitas dengan tujuan komersial, yang mana nilai penyertaan tersebut pada hakekatnya merupakan biaya akuisisi (acquisition cost) untuk memiliki atau menguasai suatu perusahaan dalam rangka memperoleh manfaat ekonomis. KepemilikanPMSolehLPSdibatasinilaidanwaktu pelepasannya (divestasi). Berdasarkan Pasal 42 UU LPS, LPS wajib menjual seluruh saham Bank Mutiara pada harga optimal yaitu paling sedikit sebesar seluruh biaya penyelamatan (PMS) yang dikeluarkan LPS paling lama 3 (tiga) tahun sejak dimulainya penanganan bank tersebut dan dapat diperpanjang sebanyak-banyaknya dua kali dengan masing-masing perpanjangan selama satu tahun (total paling lama 5 tahun). Setelah 5 tahun masa penjualan tidak diperoleh harga optimal maka LPS baru diperkenankan menjual saham bank (PMS) dengan nilai di bawah biaya penyelamatan (PMS).

Substansi ekonomi dan karakteristik PMS sebagaimana dimaksud di atas menunjukkan bahwa penyajian PMS sebesar biaya penyelamatan lebih relevan dan bermanfaat dari pada menggunakan jumlah yang dapat diperoleh kembali (recoverable amount) untuk pengambilan keputusan.

The economic substance and characteristic of the Temporary Capital Placement as stated above, shows that the decision for the Temporary Capital Placement that is based on its acquisition cost calculation is substantially relevant and beneficial than a decision made on the basis of its recoverable amount. Presentation of Temporary Capital Placement at the amount of resolution cost does not recede the ability to obtain viable financial information needed to ascertain IDICs financial ability to carry out its tasks. Based on the IDIC Law, IDICs ability to carry out its tasks (going concern) is not merely reflected by the assets that IDIC owns. Article 85 section (1) of the IDIC Law governs that in the event IDICs capital falls below the amount of its inital capital, therefore the Government, with the approval of the Indonesian parliament (DPR), to sufficiently cover the deficit. Subsequently, as prescribed within Article Pasal 85 section (2) of the IDIC Law that stipulates that in the event the IDIC experiences difficulty with its liquidity, therefore, IDIC can obtain a loan from the government. b. Arrangements on Financial Accounting Standard (SAK) By considering the economic substance of Temporary Capital Placement as stipulated in letter a above, IDIC firmly believes that the economic substance of Temporary Capital Placement is excluded from the PSAKs coverage, which regulates the the method for calculating fund placements or investments. In relation to this, PSAK 1 specifically states that, in regards as to the Presentation of Financial Statements, if a transaction is not regulated within the PSAK, therefore that specific entity has to determine the accounting policy to be applied so as to ensure the financial statements presents beneficial information for the financial statements users. 2. The impact of BPKs investigative audit of IDICs Financial Statement: In accordance with the standards for financial reporting as well as financial statement audit, the findings of this investigative audit should not be used as the basis to doubt

Penyajian PMS sebesar biaya penyelamatan tidak mengurangi kualitas informasi keuangan untuk menggambarkan kemampuan keuangan LPS dalam melaksanakan fungsinya. Berdasarkan UU LPS kemampuan keuangan (going concern) LPS dalam melaksanakan fungsinya tidak semata-mata direfleksikan oleh aset yang dimiliki oleh LPS. Pasal 85 ayat (1) UU LPS mengatur bahwa dalam hal modal LPS kurang dari modal awal, Pemerintah dengan persetujuan Dewan Perwakilan Rakyat menutup kekurangan tersebut. Selanjutnya, dalam Pasal 85 ayat (2) UU LPS diatur bahwa apabila LPS mengalami kesulitan likuiditas, LPS dapat memperoleh pinjaman dari Pemerintah.

b. Pengaturan Dalam Standar Akuntansi Keuangan (SAK) Mempertimbangkan substansi ekonomi PMS sebagaimana diuraikan pada huruf a diatas, LPS berpendapat bahwa substansi ekonomi PMS tidak termasuk dalam ruang lingkup pengaturan PSAK yang mengatur mengenai pengukuran penyertaan atau investasi. Berkaitan dengan hal tersebut, dalam PSAK 1 tentang Penyajian Laporan Keuangan dinyatakan bahwa apabila suatu transaksi belum diatur dalam PSAK maka entitas harus menetapkan kebijakan akuntansi untuk memastikan bahwa laporan keuangan menyajikan informasi yang bermanfaat bagi pengguna laporan keuangan.

seyogyanya tidak serta merta dijadikan dasar untuk meragukan kewajaran penyajian laporan keuangan LPS. LPS berpandangan bahwa temuan pemeriksaan investigasi BPK tersebut tidak berpengaruh terhadap kewajaran penyajian Laporan Keuangan LPS dengan pertimbangan bahwa: Penyaluran PMS LPS adalah sesuai dengan mandat Komite Stabilitas Sistem Keuangan dan Komite Koordinasi dalam rangka penyelamatan Bank Century yang mengamanatkan agar penyelamatan tersebut dilaksanakan berdasarkan UU LPS. Mandat tersebut telah dilaksanakan LPS sesuai dengan prosedur pengeluaran dan prosedur akuntansi yang berlaku di LPS serta telah didukung dengan bukti yang cukup dan sahih.

The disbursement of IDICs Temporary Capital Placement was carried out in accordance with the mandate provided by the Financial System Stability Committee and the Coordination Committee within the context of resolving PT. Bank Century, Tbk that specifies that the resolution is made on the basis of the IDIC Law. This mandate was implemented by IDIC in accordance with the prevailing disbursement procedures and accounting procedures as well as supported by sufficient and legal evidence. IDICsTemporaryCapitalPlacementisintheformof funds transferred from IDIC amounting to Rp5.312 trillion and in the form of IDICs State Securities (Surat Berharga Negara or SBN) amounting Rp1.450 trillion, which was transferred to PT. Bank Century, Tbk. The transfer was recognized by PT. Bank Century, Tbk,which booked the Temporary Capital Placement as equity within PT. Bank Century, Tbks balance sheet. In addition to this, the confirmation of this transfer was duly specified within the Notarial Deed prepared by Dr. Irawan Soerodjo, SH, Msi number 62 dated 10 August 2009 and duly endorsed by the Minister of Law and Human Rights number: AU-41550.AH.01.02 of 2009 dated 26 August 2009.

PMSLPSdilakukanmelaluitransferdanaLPSsebesar Rp5.312,111 miliar dan transfer kepemilikan Surat Berharga Negara (SBN) LPS sebesar Rp1.450,250 miliar ke Bank Century. Realisasi transfer tersebut telah diakui oleh Bank Century dengan mencatatkan PMS tersebut pada sisi ekuitas di Necara Bank Century. Selain itu, pengakuan atau konfirmasi tersebut telah dituangkan dalam akta notaris Dr. Irawan Soerodjo, SH, Msi nomor 62 tanggal 10 Agustus 2009 yang telah mendapat pengesahan dari Menteri Hukum dan HAM nomor : AHU-41550.AH.01.02 Tahun 2009 tanggal 26 Agustus 2009.

Di tahun ke-5 ini, tidak dapat dipungkiri bahwa tantangan Lembaga Penjamin Simpanan (LPS) untuk menjamin simpanan seluruh nasabah perbankan dan turut memelihara stabilitas sistem perbankan nasional sebagaimana diamanatkan oleh Undang-Undang Nomor 24 tahun 2004 tentang Lembaga Penjamin Simpanan (UU LPS) menjadi semakin besar. Keberadaan LPS diharapkan dapat memberikan efek tenang (peace of mind) bagi masyarakat penabung, terutama pasca krisis keuangan global yang cukup mempengaruhi keadaan ekonomi dan perbankan nasional pada tahun 2008. Oleh sebab itu, LPS perlu senantiasa dan secara berkelanjutan memberikan pelayanan yang terbaik bagi para stakeholder-nya serta melaksanakan tugas-tugas LPS dengan sebaik-baiknya. Per 31 Desember 2010 terdapat 1.990 bank peserta program penjaminan simpanan LPS yang terdiri dari bank umum, bank umum syariah, bank perkreditan rakyat dan bank pembiayaan rakyat syariah. Total simpanan nasabah bank umum yang dijamin oleh LPS posisi 31 Desember 2010 adalah sebesar Rp1.435,20 triliun (60,53% dari total simpanan nasabah bank umum). Pada tahun 2010, LPS melaksanakan proses likuidasi 10 bank gagal yang dicabut izin usahanya oleh Bank Indonesia. Dengan demikian, sampai dengan 31 Desember 2010, LPS menangani proses likuidasi 31 bank gagal yang salah satu diantaranya adalah bank umum. Dari ke-31 bank dalam likuidasi, pada tahun 2010, LPS telah selesai melaksanakan proses likuidasi atas 5 Bank Dalam Likuidasi (BDL). Sejak awal beroperasi hingga akhir tahun 2010, beban klaim penjaminan atas simpanan layak dibayar LPS adalah sebesar Rp620,75 miliar. Dari total beban klaim penjaminan tersebut, LPS telah melakukan pembayaran biaya klaim sebesar Rp584,09 miliar sampai dengan 31 Desember 2010. Beban klaim penjaminan selama tahun 2010 sebesar Rp25,55 miliar. Dari hasil rekonsiliasi dan verifikasi simpanan nasabah BDL, terdapat simpanan yang tidak layak dibayarkan oleh LPS. Mayoritas simpanan tersebut tidak layak dibayarkan oleh LPS disebabkan oleh tingkat bunga simpanan yang melebihi tingkat bunga wajar yang ditetapkan oleh LPS. Dalam rangka mengantisipasi kerugian yang akan terjadi di masa datang akibat pembayaran klaim penjaminan, LPS membentuk cadangan klaim penjaminan. Per 31 Desember 2010, cadangan klaim penjaminan LPS adalah sebesar Rp11,10 triliun.

In the fifth year, it is undoubtedly that challenges faced by IDIC in insuring depositors deposit and in maintaining the banking system stability as mandated by the Law number 24 year 2004 concerning Deposit Insurance Corporation has become greater. Thus, the existence of IDIC is expected to bring a peace of mind for depositors, especially after the occurence of global financial crisis which had affected national economy and banking condition in 2008. Therefore, IDIC need to sustainably providing good services for its stakeholders as well as put its best efforts on conducting its tasks.

As at 31 December 2010, a total of 1,990 banks which consists of conventional commercial bank, Islamic-based commercial bank, conventional rural bank, and Islamic-based rural bank were members of IDIC deposit insurance program. Total deposit insured by IDIC as of 31 December 2010 was of Rp1,435.20 trillion (60.53% of total deposit within commercial banks). In 2010, IDIC started the liquidation process for ten failed banks whose license were revoked by Bank Indonesia. Thus, by the end of 31 December 2010, IDIC has carried out liquidation process for 31 failed banks, one of which is a commercial bank. Of 31 banks in liquidation, in 2010, IDIC completed the liquidation process of five Liquidated Banks.

From the beginning of IDIC operational to end of 2010, insurance claim expenses on eligible-to-be-paid deposit amounted to Rp620.75 billion. From the total of insurance claim expenses, IDIC has paid insurance claims of Rp584.09 billion as at 31 December 2010. Insurance claim expenses in 2010 was amounted at Rp25.55 billion. From the result of reconciliation and verification on liquidated banks deposits, there were deposits which illegible to be paid by IDIC due to the interest rate of those deposits were higher than deposit insurance rate determined by IDIC.

To anticipate the potentially future loss caused by insurance claim payments, IDIC established insurance claim payment. AS at 31 December 2010, provision for insurance claims amounted to Rp11.10 trillion.

Ringkasan Eksekutif Executive Summary

Sepanjang tahun 2010, LPS terus melanjutkan proses penanganan PT Bank Mutiara, Tbk. Proses penanganan PT Bank Mutiara, Tbk tersebut difokuskan pada peningkatan kinerja bank dan aspek lainnya dalam rangka meningkatkan nilai PT Bank Mutiara, Tbk. LPS juga mulai melakukan langkah-langkah persiapan divestasi PT Bank Mutiara, Tbk seperti menyiapkan aturan divestasi, mengundang para ahli/praktisi sebagai narasumber dalam persiapan divestasi, dan mulai mempersiapkan penunjukan konsultan divestasi. Selain itu, dalam hal pengelolaan risiko, terdapat beberapa risiko LPS dalam pelaksanaan kedua fungsinya dapat berasal dari kegagalan bank peserta penjaminan dan juga pilihan skim penjaminan simpanan yang diberlakukan. Berkenaan dengan hal tersebut perlu dilakukan evaluasi skim penjaminan secara periodik untuk memastikan skim penjaminan simpanan tersebut diterapkan secara konsisten dan potensi risiko yang ada dapat diidentifikasi, dimitigasi, dan diminimalkan dampaknya. Fokus evaluasi skim penjaminan simpanan pada tahun 2010 meliputi jumlah simpanan yang dijamin dan premi penjaminan. Guna mendukung kegiatan operasional tahun 2010, LPS memfokuskan strategi SDM pada penyempurnaan struktur organisasi dan kelengkapannya, penyusunan Cetak Biru Pengelolaan SDM, proses rekrutmen pegawai, serta persiapan pengembangan sistem manajemen SDM yang terintegrasi dan pengembangan sistem manajemen berbasis kinerja. Beberapa program terkait dengan penyempurnaan Good Corporate Governance juga telah dilakukan. Program tersebut antara lain pembentukan dua komite, yaitu Komite Informasi serta Komite Remunerasi dan Nominasi, pembuatan Rencana Strategis LPS 2010-2015, penetapan budaya kinerja serta perhatian yang lebih besar pada kepentingan nasabah penyimpan.

During 2010, IDIC continues the resolution process of PT Bank Mutiara, Tbk. The resolution process of PT Bank Mutiara, Tbk was focused in the improvement of banks performance and other aspects in order to raise the value of PT Bank Mutiara, Tbk. IDIC has also started preparing for PT Bank Mutiara, Tbk divestment such as formulating divestment guidelines, inviting experts/ practitioners as speakers in the event of divestment preparation, and preparing for appointment of divestment consultant.

In addition to that, in the event of managing IDIC risks, there were some risks in the implementation of both IDIC functions which derived from member banks failures and current deposit insurance program applied. Hence, IDIC needs to evaluate its deposit insurance scheme periodically to ensure that the deposit insurance program is applied in a consistent manner and the potential risks can be identified, mitigated and minimized its effects. Focus of deposit insurance scheme evaluation in 2010 consisted of the amount deposit insured and insurance premium. To support operational activities in 2010, IDIC was more focusing to human resources strategy by refining the organizational structure, formulating blue print on human resources management, recruitment process, as well as preparing the development of integrated human resources management system and performance-based management system. Several programs which are related to the refinement of Good Corporate Governance have been made. It includes the establishment of two committees, the Information Committee as well as Remuneration and Nomination Committee, establishment of Strategic Plan 2010-2015, and discharging performance culture as well as giving more attention to the depositors interests.

LPS merupakan lembaga independen yang berfungsi menjamin simpanan nasabah penyimpan dan turut aktif dalam memelihara stabilitas sistem perbankan sesuai dengan kewenangannya. LPS dibentuk berdasarkan Undang-Undang Nomor 24 Tahun 2004 tentang Lembaga Penjamin Simpanan sebagaimana telah diubah dengan Undang-Undang Nomor 7 Tahun 2009 (UU LPS) dan mulai beroperasi sejak tanggal 22 September 2005. LPS memperoleh modal awal dari pemerintah yang merupakan kekayaan negara yang dipisahkan dan tidak terbagi dalam saham sebesar Rp4 triliun. LPS bertanggung jawab atas pengelolaan dan pengadministrasian semua kekayaannya. Selain dari modal awal, sumber dana LPS berasal dari hasil investasi serta kontribusi awal dan pembayaran premi kepesertaan oleh bank peserta. Kekayaan LPS dalam bentuk investasi hanya dapat ditempatkan pada surat berharga yang diterbitkan oleh Pemerintah dan/atau Bank Indonesia. LPS tidak dapat menempatkan investasi pada bank atau perusahaan lainnya, kecuali dalam bentuk Penyertaan Modal Sementara dalam rangka penyelamatan bank gagal.

IDIC is an independent institution that was created to insure depositor funds and actively maintain the stability of the banking system as duly authorized. Formed on the basis of Law Number 24 of 2004 concerning the Deposit Insurance Corporation, which was subsequently amended through Law Number 7 of 2009 (IDIC Law), IDIC began operations on 22 September 2005.

Tata Kelola

Initially funded by the government in the form of state funds, which was specifically allocated and is not in the form of shares amounting to Rp4 trillion, IDIC is responsible for the management and administration of all its assets. In addition to its initial capital, IDICs funds also derive from investment returns as well as the initial contribution and membership premiums paid by banks. IDICs investment assets can only be in the form of investments in marketable securities that are issued by the Government and/or Bank Indonesia. IDIC cannot invest in banks or other companies, with the exception of Temporary Capital Placements within the context of resolving a failed bank.

ORgANISASIStruktur organisasi LPS menggunakan model one tier system dengan pimpinan LPS adalah Dewan Komisioner. One tier system lebih tepat digunakan dalam rangka menjaga independensi dan fleksibilitas Dewan Komisioner dalam menjalankan tugasnya. Dalam rangka akuntabilitas dan transparansi, penerapan one tier system di LPS dilakukan dengan pemisahan fungsi penetapan kebijakan dan pengawasan dengan pelaksanaan operasional. Hal ini diatur secara jelas dalam Pasal 62 UU LPS dimana organ LPS terdiri atas Dewan Komisioner dan Kepala Eksekutif.

ORgANIzATIONIDICs organization structure utilizes the one tier system whereby its leadership is represented by the Board of Commissioners. This one tier system effectively enhances the Board of Commissioners ability to flexibly and independently perform its tasks. In terms of accountability and transparency, the implementation of a one tier system within IDIC is carried out by segregating policy and supervisory functions with that of its operational functions. This is clearly stipulated within Article 62 of the IDIC Law whereby IDICs leadership apparatus shall comprise of the Board of Commissioners and the Chief Executive Officer. The Board of Commissioners is responsible for formulating and determining policies as well as supervise within the context of the performance of the IDICs tasks and responsibilities as prescribed within the IDIC Law, while the Chief Executive Officer carries out IDICs operational activities. To deter concentration of power in a single member of the Board of Commissioners, the Commissioner that is duly appointed to serve as the Chief Executive Officer cannot concurrently serve as the Chairman of the Board of Commissioners as prescribed within Article 66 paragraph (2) of the IDIC Law.

Dewan Komisioner bertugas merumuskan dan menetapkan kebijakan serta melakukan pengawasan dalam rangka pelaksanaan tugas dan wewenang LPS sebagaimana diatur dalam UU LPS, sedangkan Kepala Eksekutif melaksanakan kegiatan operasional LPS. Untuk menghindari terpusatnya kekuasaan kepada salah satu orang anggota Dewan Komisioner, anggota Dewan Komisoner yang ditetapkan sebagai Kepala Eksekutif adalah bukan Ketua Dewan Komisioner sebagaimana diatur dalam Pasal 66 ayat (2) UU LPS.

Sepanjang tahun 2010, Dewan Komisioner LPS telah melaksanakan 152 kali rapat Dewan Komisioner. Dari 152 kali rapat tersebut, 33 kalinya merupakan rapat Dewan Komisioner sebagai RUPS Bank yang dicabut izin usahanya. LPS menetapkan 35 Keputusan Dewan Komisioner pada tahun 2010.

The Board of Commissioners convened 152 Board of Commissioners Meetings throughout 2010. Of these 152 meetings, 33 were Board of Commissioners Meetings that served as Shareholder Meetings of the banks that had their licenses revoked. IDIC produced 35 Board of Commissioners Meetings in 2010.

Untuk mendukung pelaksanaan tugas-tugas Dewan Komisioner, saat ini Dewan Komisioner memiliki satuan kerja yang bertanggung jawab kepada Dewan Komisioner, yaitu Kantor Dewan Komisioner, Komite Audit, Komite Informasi, Komite Remunerasi dan Nominasi. Satuan kerja tersebut dibentuk dalam rangka membantu tugas Dewan Komisioner dalam merumuskan & menetapkan kebijakan dan melakukan pengawasan.

To support the Board of Commissioners tasks, the Board of Commissioners currently has units that report to the Board of Commissioners, which includes the Office of the Board of Commissioners, the Audit Committee, the Information Committee, and the Remuneration and Nomination Committee. These units are formed specifically to support the Board of Commissioners tasks in formulating and determining policies as well as its supervisory tasks.

IDIC plans on 2011

Mengingat pengawasan perbankan masih dilaksanakan oleh Bank Indonesia, sesuai UU LPS, Anggota Ex-Officio yang berasal dari Lembaga Pengawas Perbankan dijabat oleh Anggota Non ExOfficio. Dalam melaksanakan tugasnya, Dewan Komisioner wajib melakukan rapat secara berkala (Rapat Dewan Komisioner/RDK) sekurang-kurangnya satu kali dalam satu bulan untuk membahas hal-hal sebagai berikut: 1) menetapkan kebijakan penjaminan simpanan nasabah; 2) menetapkan kebijakan LPS dalam mendukung stabilitas sistem perbankan; 3) mengevaluasi pelaksanaan penjaminan simpanan nasabah dan pelaksanaan peran LPS dalam mendukung stabilitas sistem perbankan; 4) menerima dan mengevaluasi hal-hal lain yang dilaporkan oleh Kepala Eksekutif; dan/atau 5) hal-hal lain yang berhubungan dengan tugas LPS.

Since bank supervision is carried out by Bank Indonesia, the ExOfficio Member that represents the Financial Supervisory Agency is held by the Non Ex-Officio Commissioner in accordance with the IDIC Law. To perform its tasks, the Board of Commissioners is required to regularly convene a meeting (the Board of Commissioners Meeting) at least once a month to discuss the following: 1) determine deposit insurance policies; 2) determine IDICs policies in support of maintaining the stability of the banking system; 3) evaluating the implementation of IDICs role of providing depositor insurance and supporting the banking systems stability; 4) receive and evaluate other matters that is reported to the Chief Executive; and/or 5) other matters pertaining to IDICs tasks.

Dewan Komisioner Dewan Komisioner LPS ditetapkan oleh Presiden sebanyak 6 orang yang terdiri dari 3 orang Ex-Officio yang mewakili Kementerian Keuangan, Bank Indonesia dan Lembaga Pengawas Perbankan (LPP), dan 3 orang yang berasal dari dalam dan/atau luar LPS. Pengelolaan Risiko LPS

FUNgSI DAN TUgAS LPSFungsi LPS yaitu menjamin simpanan nasabah penyimpan dan turut aktif memelihara stabilitas sistem perbankan. Adapun tugas LPS dalam rangka menjalankan kedua fungsinya adalah sebagai berikut: (1) merumuskan dan menetapkan kebijakan pelaksanaan penjaminan simpanan; (2) melaksanakan penjaminan simpanan; (3) merumuskan dan menetapkan kebijakan dalam rangka turut aktif memelihara stabilitas sistem perbankan; dan (4) merumuskan, menetapkan, dan melaksanakan kebijakan penyelesaian Bank Gagal (bank resolution) yang tidak berdampak sistemik. Dalam melaksanakan tugas guna menjalankan fungsi menjamin simpanan nasabah, LPS mempunyai wewenang, yaitu (1) menetapkan dan memungut premi penjaminan; (2) menetapkan dan memungut kontribusi pada saat bank pertama kali menjadi peserta; (3) melakukan pengelolaan kekayaan dan kewajiban LPS; (4) mendapatkan data nasabah, laporan keuangan bank, dan laporan hasil pemeriksaan bank sepanjang tidak melanggar kerahasiaan bank; (5) melakukan rekonsiliasi, verifikasi, dan/ atau konfirmasi data bank; (6) menetapkan syarat, tata cara dan ketentuan pembayaran klaim; (7) menunjuk, menguasakan, dan/ atau menugaskan pihak lain untuk bertindak bagi kepentingan dan/atau atas nama LPS guna melaksanakan sebagian tugas tertentu. Sedangkan dalam melaksanakan tugas guna menjalankan fungsi turut aktif memelihara stabilitas sistem perbankan, LPS mempunyai wewenang, yaitu (1) mengambil alih dan menjalankan segala hak dan wewenang pemegang saham termasuk hak dan wewenang Rapat Umum Pemegang Saham (RUPS); (2) menguasai dan mengelola aset dan kewajiban bank gagal yang diselamatkan; (3) meninjau ulang, membatalkan, mengakhiri dan/atau mengubah setiap kontrak yang mengikat bank gagal yang diselamatkan dengan pihak ketiga yang merugikan bank; dan (4) menjual dan/atau mengalihkan aset bank tanpa persetujuan debitur dan/atau kewajiban bank tanpa persetujuan kreditur. Functions AnD Duties oF iDicIDIC is responsible for insuring bank depositor funds as well as actively maintains the stability of the banking system. IDICs tasks in line with these two functions are as follows: (1) formulate and determine deposit insurance policies; (2) implement deposit insurance; (3) formulate and determine policies pertaining to its active maintenance of the banking systems stability; and (4) formulate, determine, and implement policies pertaining to the Resolution of Non-Systemic Banks.

In regards to its deposit insurance function, IDIC is duly authorized to: (1) determine and collect deposit premiums; (2) determine and collect initial membership contributions from banks; (3) manage IDICs assets and liabilities; (4) obtain depositor data, banks financial statements, and bank examination reports as long as it does not violates banking confidentiality; (5) reconcile, verify, and/or confirm bank data; (6) determine requirements, procedures and regulations pertaining to claims payment; (7) appoint, take over, and/or delegate other parties to act on behalf of the interests and/or name of IDIC to carry out a specific task.

While in regards to its role of maintaining the banking systems stability, IDIC is responsible for the following: (1) to take over and perform all shareholder rights and responsibilities including the rights and authority of the General Shareholders Meeting; (2) take over and manage assets and liabilities of the rescued bank; (3) review, cancel, terminate, and/or amend every contract that binds the rescued bank with a third party that is associated with the banks collapse; and (4) sell and/or turn over bank assets without the debtors approval and/or the banks liabilities without the creditors approval.

Insuring Banking Depositors Deposit

KepesertaanSetiap bank yang melakukan kegiatan usaha di wilayah Negara Republik Indonesia wajib menjadi peserta penjaminan, yang meliputi Bank Umum yang menjalankan kegiatan usaha secara konvensional maupun syariah, dan Bank Perkreditan Rakyat (BPR) serta Bank Pembiayaan Rakyat Syariah (BPRS). Kewajiban untuk mengikuti penjaminan berlaku pula bagi kantor cabang dari bank yang berkedudukan di luar negeri yang melakukan kegiatan perbankan dalam wilayah Republik Indonesia.

MembershipEvery bank that operates within the Republic of Indonesia, which includes Conventional and Islamic Commercial Banks, as well as Conventional and Islamic Rural Banks, are legally required to become a deposit insurance member.

Branches of foreign banks that operate within the Republic of Indonesia are also legally required to become a deposit insurance member.

Tentang LPS About IDIC

Premi PenjaminanBank peserta wajib membayar premi penjaminan sebesar 0,1% dari rata-rata saldo bulanan total simpanan dalam setiap periode. Premi tersebut dibayarkan sebanyak 2 kali dalam 1 tahun. Untuk periode Januari sampai dengan Juni, pembayaran premi dilakukan paling lambat 31 Januari. Sedangkan untuk periode Juli sampai dengan Desember, pembayaran premi dilakukan paling lambat 31 Juli.

Insurance PremiumMember Banks are required to pay a premium amounting to 0.1% of the total deposits average monthly balance within each period. This premium is paid twice a year. The premium is paid no later than the 31st of January for the period from January to June while payment is due not later than 31 July for the period from July to December of each year.

Jenis dan Nilai Simpanan yang DijaminJenis simpanan pada bank konvensional yang dijamin LPS adalah giro, deposito, sertifikat deposito, tabungan, dan/atau bentuk lainnya yang dipersamakan dengan itu. Jenis simpanan pada bank berdasarkan prinsip syariah yang dijamin oleh LPS meliputi: i. Giro dan tabungan berdasarkan Prinsip Wadiah; ii. Tabungan dan deposito berdasarkan Prinsip Mudharabah Muthlaqah atau Prinsip Mudharabah Muqayyadah yang risikonya ditanggung oleh bank; dan iii. Simpanan berdasarkan Prinsip Syariah lainnya yang ditetapkan oleh LPS setelah mendapat pertimbangan LPP.

Types and Amount of Deposits InsuredCorporate Governance The types of conventional bank deposits insured by IDIC includes current accounts, time deposits, certificates of deposits, savings, and/or other similar forms of deposits. IDIC also insures various types of Islamic bank deposits that includes: i. Current accounts and savings based on the Principles of Wadiah; ii. Savings and time deposits based on the Mudharabah Muthlaqah or Mudharabah Muqayyadah principles whose risks are borne by the bank; and iii. Other forms of Islamic deposits as determined by IDIC and upon the approval of the LPP. The maximum coverage insured by IDIC as of 13 October 2008 was changed from a previous maximum coverage of Rp100 million to a maximum coverage of Rp2 billion per customer per bank as stipulated within Government Regulation Number 66 of 2008 pertaining to the Amount of Deposits Insured by the Indonesia Deposit Insurance Corporation. The amount insured by IDIC covers the deposits balance (principle and interest) on the date of the revocation of the banks operational license.

Sejak tanggal 13 Oktober 2008 jumlah maksimum simpanan yang dijamin LPS diubah dari Rp100 juta menjadi maksimum Rp2 miliar per nasabah per bank sebagaimana ditetapkan dalam Peraturan Pemerintah Nomor Nomor 66 Tahun 2008 tentang Besaran Nilai Simpanan yang Dijamin Lembaga Penjamin Simpanan. Nilai simpanan yang dijamin LPS mencakup saldo simpanan (pokok dan bunga) pada tanggal pencabutan izin usaha bank.

Pembayaran Klaim PenjaminanDalam hal suatu bank dicabut izin usahanya oleh Bank Indonesia, LPS wajib membayar klaim penjaminan atas simpanan layak bayar setelah dilakukan rekonsiliasi dan verifikasi.

Insurance Claim PaymentsOnce a banks operational license is revoked by Bank Indonesia, IDIC is required to pay insurance claims for deposits deemed eligible (for payment) on the basis of the reconciliation and verification process of the closed bank. IDIC begins paying the eligible claims no later than 5 working days from which the reconciliation and verification process commences. IDIC is required to perform a reconciliation and verification process to determine as to which deposits are deemed eligible for payment within no later than 90 working days from the date wherein the banks license was revoked. The timeframe by which depositor claims can be submitted to IDIC is 5 years from the date in which the banks license was revoked.

LPS mulai membayar klaim yang layak dibayar selambatlambatnya 5 hari kerja terhitung sejak rekonsiliasi dan verifikasi dimulai. LPS wajib melakukan rekonsiliasi dan verifikasi untuk menentukan simpanan yang layak dibayar paling lambat 90 hari kerja terhitung sejak izin usaha bank dicabut. Jangka waktu pengajuan klaim oleh nasabah kepada LPS adalah 5 tahun sejak izin usaha dicabut.
